On 26th May, 2023, the former President of the Federal Republic of Nigeria, Muhammadu Buhari, assented to the Arbitration and Mediation Bill 2023 (the “Bill”) making it an Act, and thereby repealing the Arbitration and Conciliation Act,1988 (the “ACA”). The enactment of the Arbitration and Mediation Act, 2023 (the “AMA” or “Act”) represents a major change in the Nigerian arbitration space in nearly four (4) decades. The AMA seeks to facilitate an effective and efcient resolution of commercial disputes in Nigeria through arbitration and mediation. A sweeping review of the Act shows that it was drafted with a view to addressing the practical issues that affect arbitration within Nigeria as well as aligning the local arbitration framework with best international commercial practices.
